These Terms govern use of postpilot.agency, the free 4-article trial, the monthly Post Pilot managed publishing service, and any blog-ready website setup ordered through or in connection with Post Pilot. They are intended to satisfy the requirements for terms of electronic services under Polish law and form part of the agreement with the Service Provider. |

Legal Framework
These Terms have been prepared with regard to applicable Polish and EU law, including in particular:
the Act of 18 July 2002 on the Provision of Electronic Services, as amended (consolidated text published in Journal of Laws 2024, item 1513);
the Polish Civil Code;
the Act of 30 May 2014 on Consumer Rights, where applicable;
Regulation (EU) 2016/679 (GDPR);
the Act of 12 July 2024 - Electronic Communications Law, where applicable; and
Regulation (EU) 2024/1689 (Artificial Intelligence Act), as amended, where applicable.
Mandatory provisions of applicable law prevail over these Terms to the extent they cannot lawfully be excluded or modified by contract.
1. Service Provider and Scope
1.1. The Service Provider and operator of Post Pilot is:

1.2. These Terms apply to the electronic services made available through the Website and to Post Pilot services ordered by email, website form, payment link, invoice, order confirmation or another electronic method accepted by the Service Provider.
1.3. The Service Provider makes these Terms available free of charge before conclusion of an agreement in a form that can be saved, reproduced and retained by the recipient.
1.4. Information on the Website is intended primarily for business customers. Where mandatory consumer or consumer-like protections apply to a particular customer, Section 24 and the applicable mandatory law shall apply.
2. Definitions
Article - one original article prepared in the primary language selected for the relevant website. Additional language versions do not constitute additional original Articles for the monthly Article count.
Billing Cycle - a one-month service period starting on the activation date stated in the Order Confirmation, invoice or payment confirmation, unless the parties agree otherwise.
Client / Customer - a recipient who requests or orders the Free Trial, Post Pilot Service or Website Setup Service.
CMS - the content management system used to manage and publish content on the Client Website, including WordPress, Otack Engine or a technically compatible custom CMS.
Content Profile - the configuration used to guide article creation, including the business context, services, audience, topic direction, tone of voice, style, level of expertise, editorial or author profile, language settings and relevant website context.
Free Trial - the no-charge trial described in Section 6.
Language Version - a translated or localised version of an Article prepared for another selected website language.
Order - a request to purchase a paid service accepted by the Service Provider, including an order confirmed by email, payment, invoice acceptance or checkout.
Order Confirmation - the Service Provider's electronic confirmation of the agreed service, price, website, billing arrangement and, where relevant, additional scope.
Post Pilot Service - the managed recurring content creation, quality-control and publishing service described in these Terms.
Service Provider - Goup Space Sp. z o.o.
Website - https://postpilot.agency/ and its language versions or subpages.
Client Website - the website on which Post Pilot is requested to publish or manage content.
Website Setup Service - the optional one-time blog-ready business website implementation described in Section 11.
3. Electronic Services Available on the Website
3.1. The Service Provider may provide the following electronic services through the Website:
access to information about Post Pilot and related services;
contact and enquiry forms;
Free Trial request forms;
electronic order and payment functions where enabled;
email communication relating to enquiries, onboarding, service delivery, complaints and account or billing matters;
access to the Post Pilot blog and other informational materials.
3.2. Use of an enquiry or Free Trial form does not itself create an obligation to purchase a paid service.
3.3. The Service Provider may add, remove or modify website functions where this does not unlawfully affect an existing paid agreement.
4. Nature of the Post Pilot Managed Service
4.1. Post Pilot is a managed service. The Client purchases an ongoing publishing outcome, not access to a self-service SaaS dashboard, AI model, API key, plugin source code or internal Post Pilot administration panel.
4.2. The Service Provider configures and operates the internal publishing workflow on the Client's behalf, including AI tools, editorial settings, content profiles, quality checks, stock-media sources and technical publishing mechanisms.
4.3. The Client is not entitled to select a particular AI provider, AI model, stock-media provider, internal prompt, scoring method or other internal technical component unless expressly agreed in writing.
4.4. The Service Provider may replace or update internal AI models, providers, prompts, workflows and technical tools where reasonably required to maintain or improve the service, security, legal compliance or cost efficiency, provided the agreed commercial scope is not materially reduced.
4.5. Any future self-service plugin, downloadable software or software licence offered under the Post Pilot name is a separate product and will be governed by separate licence or subscription terms unless expressly included in an Order.
5. Standard Monthly Post Pilot Service
5.1. Unless the Order states otherwise, the standard Post Pilot Service includes:
7-8 original Articles per Billing Cycle, normally scheduled at approximately two publications per week;
up to 3 Language Versions per Article, consisting of the original language and up to two additional language versions;
topic research and planning based on the Client Website, services, audience and approved Content Profile;
AI-assisted article creation;
a separate AI editing stage and a separate AI quality-control stage, with automatic improvement and manual intervention where the workflow indicates that additional review is required;
SEO-friendly article structure, relevant keywords and metadata;
internal linking where relevant and technically supported;
structured data such as JSON-LD where relevant and technically supported by the Client Website;
selection of relevant royalty-free or appropriately licensed stock images;
direct publication to the Client Website where the technical integration permits;
email-based operational communication.
5.2. The 7-8 Article volume refers to original Articles. A translation or localisation of the same Article into another language is a Language Version and is not counted as a separate original Article.
5.3. Publication dates are approximate. The exact number of Articles and timing within a Billing Cycle may vary with calendar length, agreed scheduling, technical availability, Client approvals and other factors described in these Terms.
5.4. Post Pilot is not a complete SEO agency package. Technical SEO audits, link building, digital PR, advanced SEO strategy, extensive competitor research, paid advertising and non-standard integrations are outside the standard monthly scope unless separately agreed.
6. Free Trial - 4 Articles
6.1. Subject to technical eligibility and reasonable service capacity, a new Client may request a Free Trial consisting of 4 original Articles published on one eligible Client Website.
6.2. Each Free Trial Article may be prepared in up to 3 Language Versions where the Client Website supports those language versions.
6.3. The Free Trial is intended to allow the Client to assess the real content, formatting, stock images and publication workflow. It is not limited to demo text delivered outside the Client Website unless technical publication is not reasonably possible and the parties agree another format.
6.4. The Free Trial does not automatically convert into a paid service. The paid Post Pilot Service begins only after the Client expressly orders or confirms the paid service.
6.5. Unless otherwise agreed, the Free Trial is limited to one trial per Client Website and business. The Service Provider may refuse repeated, abusive, fraudulent or technically unsafe trial requests.
6.6. The Service Provider may refuse or postpone a Free Trial if the Client Website is technically incompatible, insecure, inaccessible, contains unlawful content, or requires a custom integration beyond the standard trial scope.
6.7. The Client may continue using the final Free Trial Articles after the trial in accordance with Section 15, even if the Client does not purchase the paid service.
7. Content Profile, Topics and Article Approval
7.1. Before recurring publication begins, the Service Provider may configure a Content Profile for the Client. The Client shall provide reasonably accurate business information and notify the Service Provider of material restrictions, regulated claims, prohibited topics or brand requirements.
7.2. Topic planning is included in the standard service. The Client may:
approve or adjust a proposed topic plan before publication; or
delegate topic selection to Post Pilot based on the approved Content Profile.
7.3. The Client may also propose its own topics, keywords, services, customer questions or content priorities.
7.4. Article-by-article review before publication is optional. If the Client requests pre-publication review, publication dates may be extended by the time reasonably required for Client feedback and implementation of agreed corrections.
7.5. If the Client has chosen mandatory topic or article approval and does not respond, publication may be paused until approval is received. A delay caused by missing Client approval is not a breach by the Service Provider and may shift the publication schedule.
7.6. Material changes to an already approved Content Profile, repeated rewriting outside the agreed direction, or additional specialist review may be treated as additional work and quoted separately.
8. AI-Assisted Content, Quality Control and Transparency
8.1. The Client acknowledges that Post Pilot uses artificial intelligence as a material part of the article creation, editing, translation and quality-control workflow.
8.2. The standard workflow may include:
AI generation based on the approved Content Profile;
a separate AI editor pass intended to identify contradictions, unsupported figures, unnecessary filler and other weaknesses;
a separate AI quality pass evaluating clarity, concreteness, repetition, keyword stuffing, terminology and source-supported claims;
automatic improvement where the quality threshold is not met;
manual intervention where the system flags a need for additional review or where the Service Provider otherwise considers it appropriate.
8.3. AI systems can produce inaccurate, incomplete or outdated information. The Service Provider applies the above safeguards but does not warrant that every statement generated or processed by AI will be error-free.
8.4. For legal, tax, financial, medical, health, regulated-product or other high-impact subject matter, the Service Provider may require Client review, a qualified subject-matter review, additional disclaimers or suspension of automatic publication. Unless expressly included in the Order, Post Pilot does not provide professional legal, tax, financial or medical advice.
8.5. Where applicable law requires disclosure that content has been artificially generated or manipulated, the Service Provider may add or require an appropriate AI disclosure. The Client shall not instruct removal of a legally required disclosure.
8.6. The parties shall cooperate in good faith to comply with applicable AI transparency obligations, including Regulation (EU) 2024/1689 where applicable to the relevant publication.
9. Images, Language Versions, SEO Elements and Structured Data
9.1. Post Pilot may select images from third-party stock libraries that allow the relevant use. Copyright and other rights in such images remain with the relevant rights holder, and use remains subject to the applicable stock licence.
9.2. Where attribution is required by the applicable image licence, the Service Provider may include the source, author or other required credit in or near the publication.
9.3. Custom photography, custom illustrations, branded graphics and paid premium-stock licences are not included unless expressly agreed.
9.4. Additional Language Versions are produced using AI-assisted translation and may be automatically localised and published. The Service Provider uses reasonable quality controls, but specialised terminology may require Client or subject-matter review.
9.5. SEO elements may include headings, metadata, keywords, article structure, internal links and structured data such as JSON-LD. Their exact implementation depends on the Client Website and CMS.
9.6. The inclusion of structured data does not guarantee that Google or another search engine will display rich results, index the Article or assign any particular ranking.
10. CMS Integration, Technical Access and Website Security
10.1. Direct publication requires suitable technical access to the Client Website. Depending on the CMS, this may involve a dedicated user account, plugin, API, webhook, token, application password or another integration method.
10.2. The Client warrants that it owns, controls or is otherwise authorised to grant the Service Provider access to the Client Website and to instruct publication of content on it.
10.3. Where possible, the Client should create dedicated credentials with only the permissions reasonably required for Post Pilot. The Client should not send unnecessary master passwords or unrelated credentials.
10.4. The Service Provider may refuse insecure access methods and may require a dedicated account, token, security update or alternative integration before publication begins.
10.5. The Client remains responsible for maintaining appropriate website backups, hosting, domain services, CMS licences, security updates and third-party subscriptions unless a separate agreement expressly assigns those responsibilities to the Service Provider.
10.6. Post Pilot will not intentionally modify unrelated areas of the Client Website. Technical changes reasonably required to create or maintain the publishing integration may be made only within the agreed scope or with Client approval.
10.7. A custom CMS integration, significant technical repair, incompatible plugin environment, broken multilingual configuration or non-standard development may require additional work and a separate quotation.
11. Optional Blog-Ready Website Setup Service
11.1. A Client without a suitable blog-ready website may order a one-time Website Setup Service. Unless a different Order is agreed, the standard advertised scope consists of:
an individually designed homepage with up to 8 homepage sections;
a blog page;
a contact page;
a contact form;
responsive implementation;
an SEO-ready technical structure;
content management access through Otack Engine; and
a publishing structure prepared for Post Pilot.
11.2. The standard advertised one-time price is PLN 1,275 net for the Polish offer or USD 350 for the international offer, unless a different price is stated in the Order Confirmation.
11.3. Hosting, domain registration or renewal, maintenance, support, external integrations, e-commerce, content migration, non-standard functionality and other additional work are not included unless expressly stated in the Order.
11.4. The Website Setup Service is a one-time implementation service and does not by itself include a mandatory recurring platform subscription. The monthly Post Pilot Service is separate unless expressly bundled in the Order.
11.5. Detailed delivery dates, content responsibilities, revisions, technical handover and any project-specific intellectual property terms are confirmed in the Order or a separate project agreement where required.
12. Orders, Contract Formation and Service Commencement
12.1. Website descriptions and prices are invitations to enter into an agreement unless expressly stated otherwise.
12.2. A paid agreement is concluded when the Service Provider accepts the Client's Order, for example by sending an Order Confirmation, accepting payment, issuing and accepting an invoice arrangement, or confirming commencement by email.
12.3. Where an online checkout is used, the Client must be given access to these Terms before placing the Order. Where consumer law applies, the ordering interface shall clearly communicate any payment obligation as required by applicable law.
12.4. Service commencement is conditional on receipt of information and technical access reasonably required to perform the service. A failure or delay by the Client in providing required access, information or approvals extends the performance schedule accordingly.
12.5. The Service Provider may carry out a technical compatibility check before accepting a paid Order. If incompatibility is discovered after payment but before meaningful performance begins and no reasonable alternative is agreed, the Service Provider shall refund the relevant payment.
13. Fees, Billing, Taxes and Renewal
13.1. The price applicable to a service is the price shown to the Client and accepted in the Order. Standard advertised prices as of the date of these Terms are USD 55 per month per website for the English/international offer and PLN 199 net per month per website for the Polish offer.
13.2. Prices stated as net do not include VAT or other taxes. VAT or another legally required tax is added or accounted for according to applicable tax rules and the Client's status and place of establishment.
13.3. Payment may be made by bank transfer, invoice, payment link, recurring payment provider or another method made available by the Service Provider.
13.4. If the Client chooses a recurring payment method, the Post Pilot Service renews for successive Billing Cycles until cancelled. If the service is paid manually, continuation may require payment of the next invoice or payment request.
13.5. The Client may cancel before the next Billing Cycle. Cancellation does not normally shorten a Billing Cycle that has already been paid for and started.
13.6. Unless mandatory law provides otherwise, monthly fees for a Billing Cycle already commenced are non-refundable solely because the Client decides to stop using the service during that cycle.
13.7. If payment is overdue, the Service Provider may pause new generation or publication until payment is received. Such pause does not constitute a breach by the Service Provider.
13.8. The Service Provider may change standard prices for future Billing Cycles. Existing recurring Clients will receive reasonable advance notice, normally at least 14 days, and may cancel before the new price takes effect.
14. Client Obligations and Prohibited Content
14.1. The Client shall cooperate reasonably with onboarding and service delivery and shall provide accurate information, lawful access and any required approvals.
14.2. The Client may not use Post Pilot to request, create or publish content that:
is unlawful, defamatory, fraudulent, discriminatory or intentionally misleading;
infringes copyright, trademark, privacy, publicity, database or other third-party rights;
contains fabricated testimonials, invented professional qualifications, false expert biographies or misleading claims of experience;
violates advertising restrictions, professional rules or sector-specific requirements applicable to the Client;
contains malware, malicious code or instructions intended to compromise systems;
promotes illegal goods, services or activities; or
otherwise exposes the Service Provider or a third party to an unreasonable legal, security or reputational risk.
14.3. If the Client asks to use the name, biography, photograph, credentials or opinions of a named expert or author, the Client warrants that the information is genuine and that the Client has the necessary permission to use it.
14.4. The Service Provider may refuse, suspend or remove a requested publication where it reasonably suspects unlawful content, rights infringement, fabricated credentials, security risk or breach of these Terms.
14.5. The Client remains responsible for sector-specific legal compliance of claims about its own products and services, including mandatory disclosures, advertising rules and regulated statements that are known or should reasonably be known to the Client.
15. Intellectual Property and Rights to Use Content
15.1. The Client retains all rights in materials, trademarks, business information, photographs and other content supplied by the Client. The Client grants the Service Provider a non-exclusive licence to use such materials solely as necessary to provide the agreed services.
15.2. After creation of a final Article, the Client receives a perpetual, worldwide, royalty-free, non-exclusive right to use, reproduce, publish, edit, adapt and distribute the final Article and its Language Versions for the Client's business purposes. The same right applies to final Free Trial Articles.
15.3. To the extent a final Article contains elements that qualify for copyright protection and such rights are held by the Service Provider, the above licence applies. The Client acknowledges that purely AI-generated elements may not qualify for copyright protection or exclusive ownership under applicable law, and the Service Provider does not guarantee exclusivity of AI-generated wording or concepts.
15.4. Stock images remain subject to the licence of the relevant stock provider or rights holder. No ownership of stock photography is transferred to the Client.
15.5. Post Pilot software, plugins, internal tools, prompts, templates, workflows, automation logic, scoring methods, models, APIs, source code, know-how, trademarks and brand elements remain the property of the Service Provider or its licensors and are not licensed to the Client except to the limited extent necessary to receive the managed service.
15.6. The managed Post Pilot Service does not include a licence to download, copy, reverse engineer, resell or independently operate the internal Post Pilot software or plugin.
15.7. Intellectual property terms for a separate Website Setup Service may be further specified in the relevant Order or project agreement. The Otack Engine core and Post Pilot technology remain proprietary unless expressly agreed otherwise.
16. Third-Party Services and Dependencies
16.1. The Post Pilot workflow may rely on third-party services, including AI providers, stock-media libraries, hosting providers, email services, payment providers, WordPress plugins, APIs and Client-selected CMS or hosting services.
16.2. The Service Provider may change third-party providers where reasonably required. The Client has no contractual right to a particular third-party provider unless expressly stated in the Order.
16.3. Third-party services may be subject to outages, API limits, licence changes, security incidents or changes in functionality outside the Service Provider's reasonable control. The Service Provider will use reasonable efforts to maintain the service or implement an alternative where practicable.
16.4. The Service Provider is not responsible for the Client's separate agreements, charges or compliance obligations relating to the Client's hosting, domain, CMS licences, paid plugins or other third-party services not expressly included in the Order.
17. SEO, Search Engines and Business Performance
17.1. Post Pilot is designed to support regular, SEO-friendly publishing. It does not guarantee any particular ranking, indexing, organic traffic level, lead volume, revenue, conversion rate, visibility in AI search systems or other commercial outcome.
17.2. Search-engine and AI-discovery results depend on factors outside the Service Provider's control, including domain authority, technical SEO, competition, backlinks, website quality, algorithms, search demand and third-party platform policies.
17.3. Search engines may choose not to index a publication, may change how they evaluate AI-assisted content, or may alter ranking systems without notice. Such changes do not by themselves constitute defective performance of the Post Pilot Service.
18. Personal Data and Data Processing
18.1. Personal data processed by the Service Provider for its own purposes is handled in accordance with the Post Pilot Privacy Policy available on the Website and applicable data-protection law.
18.2. Where the Service Provider processes personal data contained in the Client Website or other Client systems solely on the Client's documented instructions, the Client acts as controller and the Service Provider may act as processor. Where Article 28 GDPR applies, the parties shall enter into or otherwise put in place an appropriate data processing agreement.
18.3. The Client shall not provide unnecessary special-category personal data, confidential personal data or third-party personal data for inclusion in AI prompts or publications unless there is a lawful basis and the processing has been expressly agreed.
18.4. The Service Provider may use approved subprocessors and technology providers as described in the Privacy Policy and any applicable data processing agreement.
19. Confidentiality
19.1. Each party shall use reasonable care to protect non-public business information, CMS credentials, unpublished content plans and other confidential information received in connection with the service.
19.2. Confidentiality does not apply to information that is public through no breach of these Terms, was lawfully known before disclosure, is independently developed, is lawfully received from another source, or must be disclosed by law or competent authority.
19.3. The Service Provider may share confidential information with personnel, contractors and subprocessors who need it to perform the service and who are subject to appropriate confidentiality obligations.
20. Service Availability, Maintenance and Suspension
20.1. The Service Provider uses reasonable efforts to operate the Website and Post Pilot workflow reliably, but does not guarantee uninterrupted or error-free availability unless a separate SLA has been agreed.
20.2. Temporary interruption may occur due to maintenance, security updates, third-party outages, hosting failures, CMS changes, API restrictions or force majeure.
20.3. The Service Provider may suspend generation or publication where necessary for security, legal compliance, non-payment, investigation of misuse, protection of third-party rights or prevention of damage to the Client Website or Post Pilot infrastructure.
20.4. Where a publication delay is caused by a Client-side outage, missing access, approval delay or other Client dependency, the monthly schedule may be rescheduled. Such delay does not automatically entitle the Client to a refund.
20.5. Where practicable, the Service Provider may carry delayed publications into a later period or agree another reasonable catch-up schedule.
21. Cancellation and Termination
21.1. The standard Post Pilot Service does not require a long-term commitment unless a separate agreement states otherwise.
21.2. The Client may cancel the recurring service at any time by email or through an available billing mechanism. Unless otherwise agreed, cancellation takes effect no later than the end of the current paid Billing Cycle and prevents the next renewal.
21.3. The Service Provider may terminate a recurring service on reasonable notice, normally at least 14 days, or immediately if the Client materially breaches these Terms, fails to pay, creates a security risk, requests unlawful content or makes continued performance unlawful or technically unsafe.
21.4. Termination does not remove Articles already lawfully published on the Client Website. The Client may keep, edit or remove them subject to the rights and third-party licences described in Section 15.
21.5. On termination, the Service Provider may revoke or delete its own integration credentials and internal connection settings. The Client should revoke dedicated credentials or tokens granted to Post Pilot where appropriate.
21.6. Accrued payment obligations, confidentiality, intellectual property, liability and any provisions intended by their nature to survive termination remain in effect after termination.
22. Liability
22.1. The Service Provider is responsible for performing the agreed service with reasonable professional care, subject to the nature of AI-assisted content and the dependencies described in these Terms.
22.2. To the fullest extent permitted by law, the Service Provider is not liable for loss or damage resulting solely from:
incorrect, incomplete or unlawful information, instructions or materials supplied by the Client;
Client edits made after publication;
Client failure to obtain required approvals or rights;
search-engine ranking changes, de-indexing, algorithm updates or lack of expected traffic;
failures or changes in third-party hosting, CMS, plugins, APIs, AI systems, stock-media providers or communication platforms outside the Service Provider's reasonable control;
use of a publication as professional legal, medical, financial, tax or other regulated advice where such specialist service was not expressly included;
security vulnerabilities or defects already present in the Client Website or introduced by third parties outside the agreed Post Pilot scope.
22.3. For Clients acting in the course of business, and to the fullest extent permitted by law, the Service Provider shall not be liable for indirect or consequential loss, loss of profit, loss of anticipated savings, loss of business opportunity or reputational loss.
22.4. For business Clients, the Service Provider's aggregate contractual and tort liability arising from the Post Pilot Service is limited to the total net fees paid for the affected Post Pilot Service during the 3 Billing Cycles immediately preceding the event giving rise to the claim. For a one-time Website Setup Service, the liability cap is the net amount paid for that one-time service.
22.5. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law, including liability for damage caused intentionally.
23. Complaints
23.1. Complaints concerning electronic services, the Free Trial, Post Pilot Service or Website Setup Service may be submitted:
by email to hello@postpilot.agency; or
in writing to Goup Space Sp. z o.o., ul. Hoża 86/210, 00-682 Warsaw, Poland.
23.2. A complaint should, where possible, include the Client's name or company name, website address, contact email, description of the issue, relevant dates and the requested resolution.
23.3. The Service Provider will review a complete complaint without undue delay and normally within 14 days of receipt. If additional information is necessary, the Service Provider may request it before completing the review.
23.4. Mandatory complaint or response periods applicable to Consumers or other protected persons prevail where they provide greater protection.
24. Consumers and Natural-Person Entrepreneurs with Consumer Rights
24.1. The standard Post Pilot commercial offer is intended primarily for business websites and professional customers. This Section applies only where the Client legally qualifies as a consumer or as a natural-person entrepreneur entitled to consumer protections under Polish law for the relevant contract.
24.2. A person entitled to the statutory right of withdrawal from a distance contract may withdraw within 14 days of conclusion of the service agreement without giving a reason, subject to statutory exceptions and the rules below.
24.3. If such a Client expressly requests that a paid service begin before the 14-day withdrawal period expires and later withdraws, the Client may be required to pay a proportional amount for the service properly performed up to the time of withdrawal, to the extent permitted by law and provided the required information and consent were obtained.
24.4. Where the service has been fully performed before the withdrawal period expires, the right of withdrawal may be lost only where all statutory requirements for that loss have been satisfied, including the Client's prior express consent and acknowledgement where required by law.
24.5. The Free Trial does not create a payment obligation and does not automatically convert into a paid contract.
24.6. A withdrawal statement may be sent to hello@postpilot.agency or to the registered office address. A model form is included in Appendix 2, but use of that form is not mandatory.
24.7. Nothing in these Terms limits mandatory statutory rights concerning conformity of services, unfair contract terms, withdrawal, refunds, court jurisdiction or other consumer protections.
25. Minimum Technical Requirements and Security Risks
25.1. To use the Website and electronic communication services, the recipient generally needs:
a device with Internet access;
a current web browser supporting standard web technologies;
JavaScript enabled where required by forms or interactive functions;
access to a functioning email account;
for direct publication, a compatible CMS and suitable technical access to the Client Website.
25.2. Internet services involve ordinary risks including malware, phishing, credential theft, unauthorised access and service interruption. Users should maintain current security software, strong passwords, multi-factor authentication where available and appropriate backups.
25.3. The Service Provider does not introduce software into the Client's system other than components or integrations reasonably required for the agreed service and disclosed or authorised as part of the technical setup.
26. Amendments to These Terms
26.1. The Service Provider may amend these Terms due to changes in law, regulatory guidance, security requirements, technology, AI providers, payment methods, service functionality or the business model.
26.2. New Terms apply immediately to new Orders from the date stated in the updated version.
26.3. For an existing recurring paid service, material changes affecting the Client's rights or obligations will normally be communicated at least 14 days before they take effect. The Client may cancel the recurring service before the effective date of the change.
26.4. Changes required urgently by law, regulator instruction, cybersecurity risk or prevention of abuse may take effect on shorter notice where reasonably necessary. The Service Provider will inform affected Clients as soon as practicable.
27. Governing Law, Disputes and Language
27.1. These Terms and agreements governed by them are subject to Polish law, without prejudice to mandatory protections that may apply to Consumers under the law of their habitual residence.
27.2. For disputes with business Clients, the court having jurisdiction over the registered office of the Service Provider shall have jurisdiction, unless the parties agree otherwise or mandatory law requires another forum.
27.3. Consumer disputes are resolved by the court having jurisdiction under applicable mandatory procedural law. A Consumer may also seek information about available out-of-court consumer dispute-resolution bodies from competent consumer authorities. The former EU ODR platform is no longer in operation.
27.4. If these Terms are published in more than one language, the Polish version shall prevail in the event of inconsistency, to the extent permitted by applicable law, unless an Order expressly states otherwise.
28. Final Provisions and Contact
28.1. If any provision of these Terms is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. The invalid provision shall be interpreted or replaced, where legally possible, in a manner that most closely reflects its lawful commercial purpose.
28.2. Failure by either party to enforce a right immediately does not constitute a waiver of that right.
28.3. Matters not regulated by these Terms are governed by applicable Polish and EU law.
